Terms and Conditions
in which Quality Telephone Inc. (Qtel) will
provide service, and the conditions the subscriber
(The Customer) agrees to upon signing up for
services. This agreement is the contract between
the subscriber and Qtel, the Competitive Local
Exchange Carrier of this service. You understand
the following:
1. You agree to read this document,
or have it read to you in full, agree to it,
and you have fully understood it. Upon payment
for services, this agreement becomes binding
and remains in full force until such a time
that the agreement is terminated by either party
by disconnection of services.
2. By signing up for services (making
your initial payment), you are entering into
a contractual agreement for local phone service
with Qtel as your Local Carrier. You agree to
allow Qtel to act as your agent in all negotiations
with any Incumbent Local Exchange Carrier (ILEC).
You authorize Qtel to handle all negotiations
for service requests at the service address
you specify and for the phone number that Qtel
has assigned to you. This authorization does
not prevent you from changing carriers.
3. By providing your initial payment,
you request Qtel to install local phone service
at the service address you specify.
4. Qtel is not responsible for any
failure by any Incumbent Local Exchange Carrier
(ILEC) to process orders or for any problems
such as wiring, jack installation or prior existing
service at your residence. You fully understand
that Qtel only provides dial tone to the outside
of your home (or first point of contact) and
any additional wiring from the Network Interface
Device (NID) or (first point of contact) to
your home is the responsibility of homeowner
and/or landlord. Qtel does not and will not
provide inside wire work, except where required
by law.
5. Qtel does not request a deposit
for your new phone service. Should your service
be suspended or disconnected (including voluntary
disconnection requested by you), you will be
charged a reconnection fee of Twenty-Five Dollars
($25). If you pay your bill late, you will be
responsible for a late charge of Ten Dollars
($10) from the 1st day to the 6th day late and
Twenty-Five Dollars ($25) from the 7th day forward
or the maximum allowed by law.
6. In some areas there is a service
charge for adding features to your new or existing
phone service. You agree to pay the service
charge and any additional fees associated with
your new or existing service. All charges for
services will begin on the first day dial tone
is connected. Your telephone bill will be due
in full 24 days after your initial turn on date
and the same date (Due Date) each month thereafter
for each month which service is connected. You
agree to pay the current rate that Qtel is charging
for your basic telephone service and agree to
pay any late charges associated with a missed
due date. The basic rate does not include taxes,
Qtel fees (if applicable), or surcharges imposed
by State, Federal and Local authorities, and
you understand you will be responsible for these
additional charges.
7. The statement for your service,
as well as any past due amounts for services,
fees or late charges you owe, will be mailed
to you no less than fifteen (15) days prior
to your due date. You agree to make your payment
at any authorized Qtel payment center, by credit
or debit card or mail your payment (money orders
only) directly to: Qtel at P.O. Box 7310, Dallas,
TX 75209-0310.
8. Your payment is due on or before
your due date. Qtel does not provide a Grace
Period. If Qtel does not receive your payment
on or before your due date, you will be sent
a Disconnection Notice. If payment is not received
within eight (8) calendar days of the Due Date,
your telephone service may be suspended or disconnected.
If your service is suspended or disconnected,
you will have to pay all outstanding charges
and the reconnection fee to restore service.
9. Qtel may suspend or disconnect
your service, at its judgment, for the following
reasons, among others: A) Your bill has not
been paid on time or in full; B) Charges not
authorized by Qtel have been billed to your
telephone number and you have not reimbursed
Qtel for the charges; C) Your calling area is
measured and you exceed the maximum number of
calls allowed. In the event your service is
suspended for excessive per call charges, you
will be responsible for all charges associated
with the calls and any reconnection fees.
10. If your service is interrupted
in error by Qtel for any reason, your account
will be credited a prorated amount, based on
daily usage, of your monthly service payment
equal to the dollar amount for the service which
you did not receive. The amount credited will
be calculated using the base phone service amount.
Taxes and fees will not apply in this calculation.
The credit will be applied at the discretion
of Qtel to either the current billing or your
next bill following the disruption in service.
If your service is accidentally disconnected
for any other reason, you will hold Qtel harmless
against any claims that may arise from direct
or indirect damages that may occur as a result
of such a disruption of service including but
not limited to your inability to call or access
911 emergency services.
11. Qtel's Local Service allows
unlimited calls (except in areas of measured
service), access to "800" toll-free numbers
and 911 emergency services. Qtel provides blocks
for direct dial long distance, using 0+, 1+
dial, 900, 700, 976 toll calls; use of directory
assistance; or third party billing; or accepting
collect calls. In the event any of these services
are used from your phone, you understand that
Qtel will bill your account for the usage of
these features.
12. Qtel places toll restrictions
on local phone service. However, toll restrictions
are not 100% effective and you agree to pay
for any charges for such toll calls that are
made from the telephone number assigned to you
by Qtel. You agree that you are solely responsible
and will reimburse Qtel for any such charges
arising from the use by you or any other party
from the number assigned to you by Qtel. Qtel
will not charge you a late fee for calls charged
to your bill which should have been properly
blocked by the incumbent local exchange carrier
(ILEC). However, failure to reimburse Qtel for
these unauthorized types of calls may result
in the suspension or disconnection of your phone
service until all past due charges are paid
to Qtel, including any reconnection fee.
13. Long distance calls are not
included in your basic monthly local phone service.
You authorize Qtel to charge your account for
abuse of services that are not blocked and used
from the number assigned to you by Qtel.
14. Qtel will charge Twenty-Five
Dollars ($25) for orders canceled for new service
after the order has been submitted to Qtel.
There will be no service refund once an order
is processed or service is connected, for any
reason. Qtel will not issue a refund for a delay
in service for missed appointment or a delay
in service due to existing or prior service
that has not been fully disconnected. Qtel will
charge Twenty- Five Dollars ($25) for missed
appointments for new service. It is your responsibility
to be available from 8:00 a.m. to 8:00 p.m.,
Local Time, on the day of phone installation.
15. All questions regarding your
service, including repairs, are to be directed
to the offices of Qtel at 1-877-4-MY-QTEL
(Toll-Free 1-877-469-7835).
16. Qtel is not a telephone contractor
and does not provide inside wire repair. Any
repair or service performed on your line will
be done at your own risk and expense. If at
your request Qtel sends a repair technician
to fix a problem with your phone line and the
problem is an inside wire problem, you agree
to reimburse Qtel for any charges associated
with the visit, including but not limited to
a missed appointment. Failure to reimburse Qtel
for any charges imposed on Qtel from the Incumbent
Local Exchange Carrier may result in the suspension
or disconnection of your phone service. In the
event your service is suspended for wire repair
problems, you will be responsible for all charges
associated with the repairs and any reconnection
fees.
17. Qtel pays for your installation
fee. Your account will be assessed an $80 charge
for the line installation (where applicable
by law). Your account will be credited $5 toward
your line installation fee until paid in full
each month you pay your balance in full after
your initial payment. The remaining line installation
fee is due in full if you decide to transfer
your existing service to another provider. If
you decide to fully disconnect your line for
any reason, any remaining installation fee is
due in full at the time of disconnection. Qtel
will charge $20 for migration blocks (where
applicable) to be removed. If a customer decides
to change telephone service providers, they
must be current with their account balance and
pay the service fee to have the migration block
removed (where applicable).
18. Qtel will allow long-distance
calls to the 48 contiguous United States only
if you sign-up for the long-distance service
provided through Qtel. Your account must remain
paid-in-full, including the costs billed to
you for the long-distance service, in order
for Qtel to continue providing you with access
to long-distance. Long-distance is to be used
for residential voice use only. Suspicious activity,
calls made to outside the contiguous 48 states,
calls for data transmission (including Internet
and fax usage), or patterns of usage inconsistent
with home voice calling will result in immediate
termination of long-distance service with no
recourse to you. Long-distance minutes expire
at the end of each service month.
19. If you decide to disconnect your
service from Qtel, you must either submit the
request in writing to Qtel, P.O. Box 7310, Dallas,
TX 75209-0310, by fax to 1-972-546-9991, or
you can send us an e-mail at
